Fort Kinnaird Lilo & Stitch Competition – Terms and Conditions
1. The promoter is: Fort Kinnaird Nominee Limited (company number 11281232) of York House, 45 Seymour Street, London, W1H 7LX (the “Promoter”).
2. The title of the competition is “Fort Kinnaird VIP Lilo & Stitch Competition”.
3. The competition will run from 09:00am on Monday 19th May to 23:59 on Monday 26th May.
4. All competition entries must be received by the Promoter at the email address set out at condition 5 by no later than 23:59 on Monday 26th May (“Closing Date”). All competition entries received after the Closing Date are automatically disqualified.
5. Enter the competition by emailing [email protected] with the following information:
(a) your full name; and
(b) a description of why you or the person who you will share the prize with is the biggest Stitch fan (this may include, for example, because you or they: are an avid collector of Stitch merchandise, can quote every line of Stitch in the film, adore Stitch’s charm etc.)
by the Closing Date.
6. If you win, you may be asked to provide comments on your experience and to take part in a professional photoshoot for marketing purposes. Providing comments on your experience and taking part in the professional photoshoot will naturally be subject to your consent and a filming agreement.
7. The competition is free to enter, and no purchase is necessary.
8. The Promoter will not accept:
(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
(b) proof of posting or transmission as proof of receipt of entry to the competition.
9. By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
10. The competition winner will be selected by a panel made up of representatives selected by the Promoter. The panel will select as the winning entry, the entry which they consider most persuasive (on the basis on the information described at condition 5(b)).
11. The panel will select one winner.
12. The winner will be selected from all qualifying entries by Tuesday 27th May (“Selection Date”).
13. The competition is only open to all residents in Edinburgh aged 18 years or over except:
(a) employees of the Promoter or its holding or subsidiary companies;
(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
14. Parents or guardians must enter on behalf of anyone under the age of 18.
15. In entering the competition, you confirm that you are eligible to do so and are eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.
16. The Promoter will not accept competition entries that are:
(a) automatically generated by computer;
(b) completed by third parties or in bulk;
(c) illegible, have been altered, reconstructed, forged or tampered with;
(d) photocopies and not originals; or
(e) incomplete.
17. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
18. The prize will be made up of:
(a) Part 1: Six cinema tickets to the new Lilo & Stitch film; and
(b) Part 2: a hamper containing over £150 worth of merchandise.
19. The prize is subject to availability. There is no cash alternative for the prize.
20. The prize is not negotiable or transferable.
21. Part 1 of the prize (as described at condition 18a) is supplied by and can only be redeemed at ODEON Fort Kinnaird Retail Park, Newcraighall Road, Edinburgh EH15 3HP.
22. Part 2 of the prize (as described at condition 18b) is supplied by the Promoter and can be collected from the Management Suite at Fort Kinnaird Retail Park, 32 Fleming House, Newcraighall, Edinburgh EH15 3RD.
23. The decision of the panel of Fort Kinnaird representatives is final, and no correspondence or discussion will be entered into.
24. The Promoter will contact the winner personally as soon as practicable after the Selection Date, using the email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.
25. If you are the winner of the prize, you will have two days from the date on which the Promoter contacts you to claim the prize by replying to the email sent to you. If you do not claim the prize by this date, your claim will become invalid.
26. The prize may not be claimed by a third party on your behalf.
27. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available or has not claimed their prize within two days of the Selection Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.
28. The next eligible entrant selected pursuant to condition 27 above will be required to claim their prize within 2 days from date on which the Promoter notifies you that you have won the prize. If the prize is not claimed within the specified time period, the claim will become invalid.
29. The Promoter does not accept any responsibility if you are not able to take up the prize.
30. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
31. The Promoter will only process your personal information as set out in the Privacy Notice.
32. You agree that the Promoter may, but is not required to, make your entry available on its website www.fortkinnaird.com and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry for such purposes.
33. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
34. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
35. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
