Fort Kinnaird ‘Edinburgh’s youngest sustainability hero’ competition – Terms and Conditions

 

  1. The promoter is: Fort Kinnaird Nominee Limited (company number 11281232) of York House, 45 Seymour Street, London, United Kingdom, W1H 7LX (the “Promoter”).
  2. The title of the competition is “Edinburgh’s youngest sustainability hero’” competition.
  3. The competition will run from 6:00pm on 24 July 2026 (the “Opening Date”) to 11:59pm on 29 July 2026 (the “Closing Date”) inclusive or at an earlier time or date determined by the Promoter if:

(a) all prizes have been won; or

(b) forced to do so by circumstances outside its reasonable control.

  1. All competition entries must be received by the Promoter (or the Promoter’s PR Agency) at the address set out at condition 5 by no later than 11.59pm on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
  2. Enter the competition by emailing the following information to [email protected] by the Closing Date:
    • the Nominee’s (as defined in condition 12) full name; and
    • A description of the creative ways the nominee is helping to protect the planet. This could include, for example, growing their own plants or vegetables, collecting litter in their local area, reusing and recycling materials for crafts, walking or cycling instead of driving where possible, reducing plastic use, or encouraging family and friends to make more eco-friendly choices by the Closing Date.
  3. The competition is free to enter with no purchase being necessary.
  4. The Promoter will not accept:
    • responsibility for competition entries that are corrupted, not successfully completed or transmitted, lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, website, computer hardware or software failure, or lack of internet or mobile network connectivity of any kind; or
    • proof of posting or transmission as proof of receipt of entry to the competition.
  5. By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
  6. The competition entries will be judged by a judge or panel of judges from City Press Services Limited (an agency that provides PR services to the Promoter (the “Promoter’s PR Agency”).) The judge or panel of judges from the Promoter’s PR Agency will select the winning competition entry based their evaluation of the information provided pursuant to condition 5(b) and what they consider to be the most deserving entry. The decision of the judge or panel of judges (acting reasonably) will be final.
  7. The Promoter will provide the full names of the judges to anyone who writes within one month after the Closing Date of the competitionrequesting details of the judges and who encloses a self-addressed envelope to the address set out above.
  8. There will be only one winner of the competition.
  9. Except for as provided in condition 13, the competition is open to all residents in the UK. Persons entering the competition (a “Nominator”) must:
    • be aged 18 years or over; and
    • be entering the competition on behalf of a person aged under 18 years and of whom they are the parent or legal guardian (a “Nominee”).
  10. The competition is not open to:
    • employees of the Promoter or its holding or subsidiary companies;
    • employees of agents or suppliers (including the Promoter’s PR Agency) of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
    • members of the immediate families or households of (a) and (b) above.
  11. The Promoter (or the Promoter’s PR Agency) may ask the Nominator to provide:
    • proof of their age;
    • proof that they are the legal parent or guardian of the Nominee; and/or
    • confirmation of eligibility to claim the Prize.
  12. In entering the competition, you confirm that:
    • you are eligible to do so;
    • you are eligible to claim any prize you may win;
    • you are the parent or legal guardian of the Nominee; and
    • you consent to sharing information on behalf of the Nominee, and agree that your and the Nominee’s personal information will be processed in accordance with these terms and conditions.
  13. The Promoter (or the Promoter’s PR Agency) may require you to provide proof that you are eligible to enter the competition.
  14. The Promoter (and/or the Promoter’s PR Agency) will not accept competition entries that are:
    • automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);
    • completed by third parties or in bulk;
    • illegible, have been altered, reconstructed, forged or tampered with;
    • photocopies and not originals; or
  15. The Promoter (or the Promoter’s PR Agency) reserves all rights to disqualify you if your or the Nominee’s conduct is contrary to the spirit or intention of the prize competition.
  16. The prize comprises:
    • 4x tickets to the new Spider Man film;
    • a sustainability kit
    • a family meal provided by Frankie and Benny’s (up to a maximum of £75),

(the “Prize“).

  1. The following suppliers (each a “Supplier”) respectively supply the following parts of the Prize:

 

  • the part of the Prize described in condition 19(a) is supplied by ODEON Fort Kinnaird Retail Park, Newcraighall Road, Edinburgh EH15 3HP.
  • the part of the Prize described in condition 19(b) is supplied is supplied by the Promoter and can be collected from the Management Suite at Fort Kinnaird Retail Park, 32 Fleming House, Newcraighall, Edinburgh EH15 3RD.
  • the part of the Prize described in condition 19(c) is supplied by Frankie and Bennys is supplied by the Promoter and can be collected from the Management Suite at Fort Kinnaird Retail Park, 32 Fleming House, Newcraighall, Edinburgh EH15 3RD.
  1. Each constituent part of the Prize is subject to the individual terms and conditions of the respective Supplier. Participants are solely responsible for locating, reviewing and adhering to the applicable Supplier terms and conditions (or the terms and conditions of the entity that operates the Supplier (or any holding or subsidiary companies thereof)).
  2. The Prize (and each constituent part thereof) is subject to availability. There is no cash alternative to the Prize (or any constituent part thereof). The Promoter reserves the right to substitute or cancel any of constituent part of the Prize where necessary.
  3. The Prize (or any constituent part thereof) is not negotiable or transferable.
  4. The winner will be selected by 11:59 pm 30 July 2026 (the “Selection Date.”).
  5. The Promoter will contact the Nominator of the winning Nominee personally as soon as practicable after the Selection Date, using the email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.
  6. The winner of the competition (being the winning Nominee) will be announced via social media and local press on or around the Selection Date. If you are the Nominator of the winning Nominee and you object to any or all of your or the Nominee’s first name, surname, county and winning entry being published or made available, please contact the Promoter. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
  7. Decisions of the Promoter and the Promoter’s PR Agency are final and no correspondence or discussion will be entered into.
  8. The Promoter will make reasonable efforts to contact the winner via email.
  9. If you are the Nominator of the winner of the Prize, you will have two days from the Selection Date to indicate to you wish to claim the Prize. You must indicate that you wish to claim the Prize by responding, to the email received from Promoter’s PR Agency before 5pm on 31 July 2026. If you do not indicate that you wish to claim the Prize by this date, your and your Nominee’s claim will become invalid.
  10. The Prize must be collected from Fort Kinnaird Shopping Centre, Edinburgh (the “Centre”) between the hours of 11:00am and 16:00am on 1 August 2026 (the “Prize Date”). When indicating that you wish to claim the Prize, you must confirm that the Nominator and the Nominee are available to collect the Prize on the Prize Date. Any failure to attend as such will result in your and your Nominee’s claim becoming invalid.
  11. The Prize may not be claimed by any person other than the Nominator and the Nominee together.
  12. If the winner cannot be contacted or is not available on the Prize Date or has not indicated that they wish to claim the Prize as set out in condition 29, the Promoter (or the Promoter’s PR Agency) reserves the right to offer the prize to another eligible entrant selected by the judge or panel or judges referred to in condition 9.
  13. The Promoter does not accept any responsibility if you are not able to take up the Prize in the manner specified in these terms and conditions.
  14. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
  15. You agree that the Promoter (and/or the Promoter’s PR Agency) may, but is not required to, make your entry available on their websites, social media channels and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.
  16. The Promoter will only process your and the Nominee’s personal information as set out in its privacy notice available here: https://www.britishland.com/privacy-notice/. See also condition 26 with regard to the announcement of winners.
  17. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
  18. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
  19. If the Prize is being given as part of the Promoter’s event at the Centre and the following conditions shall apply:
  1. all participants must follow the directions and instructions of the event staff at all times. Failure to do so may result in disqualification from the competition and/or removal from the event area; and
  2. the Promoter and any appointed event staff reserve the right to remove any person from the event who is behaving in a disruptive, abusive, or dangerous manner, or who is otherwise in breach of these terms and conditions. The decision of the Promoter will be final.
  3. Please be aware that you and the Nominee may appear in the aforementioned event-related media and by attending the event and collecting the Prize you provide your consent for us to use this media for reasonably appropriate purposes.
  4. These terms and conditions shall be governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
